We Care About Patients in Long-Term Care Facilities

According to the most recently available statistics from the CDC, 8.5 million people visited long-term care facilities in 2016. 18% of America’s 50 million elderly citizens (age 65+) live in a long-term facility, a population that is expected to grow to 98.2 million by 2060. Paramount to a successful transition of America’s aging population to long-term care facilities is resident safety.
Long-term care is a $166 billion industry. Yet despite the large sums spent on long-term care, facilities sometimes make decisions to protect their own bottom line at the expense of residents, deviating from the standard of care required by law. Insufficient medical provider staffing, improper employee screening or training, inadequate resident to employee ratios, outdated policies, or insufficient PPE or other equipment are examples of how long-term care facilities’ decisions may cause serious harm to a vulnerable loved one.
Much of the long-term care industry is for-profit, creating powerful incentives to the detriment of residents. The federal government regulates long-term care facilities in part, but under current CMS regulations, long-term facilities may use arbitration agreements. Before they ever receive any care from a long-term facility, for all practical purposes, many residents sign away many legal rights.
Because the health of loved ones at long-term facilities should not be compromised, residents and their representatives should consider all legal options to remedy wrongs.
